Don’t Make These Mistakes after a Car Accident
Knowing what NOT to do in the days and weeks following a car accident is just as important as knowing what to do. Without realizing it, things you say or do can easily jeopardize the successful outcome of a personal injury claim. What do you need? Who do you talk to? Or, rather, what do you NOT do after a car accident? Here are some mistakes to avoid after a car accident.

- Do not freak out or lose control. Remain as calm as possible throughout the entire process.
Do not post on social media. Social media updates can backfire on you. Posts, pictures, and status updates can be found by the defense attorney, insurance company, and others and used against you.
- Do not give a recorded statement of any kind to the other side’s insurance company. Do not agree to have any conversations recorded; it is not required, and it is against the law for you to be recorded without your permission.
- Never admit fault or imply that you may have been at fault. Wait to see what the official investigation determines. Avoid roadside conversations about the responsibility of the accident. Take care to avoid making statements that can be construed as an admission of guilt.
- Do not sign documents for the release of your medical records and bills (or anything else).
- Do not speak with an insurance adjuster before getting medical care. Do not sign any medical authorization release forms sent by the other person’s insurer. Never authorize the release of medical records to anyone without first consulting your lawyer.
- Do not give health information to anyone other than your healthcare providers (i.e., ER doctors, etc.).
- Do not give your auto carrier information to healthcare providers.
- Do not forget to document the scene of the accident (take pictures, etc.).
- Do not give any details of the accident or injuries. Tell them you are still receiving treatment, and you can’t provide any details yet. Something could be left out; another injury could still be discovered or something could turn out to be worse than originally thought.
