The DePuy ASR metal-on-metal hip recall could turn into one of the largest medical device failures in history. Almost 100,000 of these hip replacements were surgically implanted into patients worldwide. Only now are the debilitating effects starting to surface, including pain, dislocation, loosening, and chromium and cobalt metal poisoning. Many DePuy hip patients are facing their second or even third revision surgery to replace the defective ASR hip joints. Johnson & Johnson says they’ll cover “reasonable and customary costs ” of treatment, but that gives them a say in your future medical treatment. It could also hurt your case against the companies that caused your medical problems in the first place.
Johnson & Johnson hired a company called Broadspire to handle patient claims. Broadspire collects medical records, sends out complicated forms to fill out and sign, and their adjustors even decide if a patient qualifies for another surgery. Don’t allow Broadspire, Johnson and Johnson, or DePuy to decide if you need another hip implant. You and your doctor are the only ones who should make that decision. Don’t give them your private medical records either. The information they want can be used against you later on if you decide to go to court. Broadspire was hired to manage the DePuy ASR hip recall for Johnson & Johnson, not for you.
2. Don’t Call the DePuy Hotline Before Talking to an Attorney
Again, these companies will try to limit their liability in your case. Any information you hand over to them can be used against you later on in court. Before you do anyting, talk to a medical product liability lawyer, like the experienced attorneys at the Nash & Franciskato Law Firm. We are a leading national law firm in the area of hip replacement litigation. Our attorneys have extensive experience handling hip replacement and knee replacement lawsuits, obtaining over $4.5 million in settlements for people whose joint replacement devices went bad.
Johnson & Johnson and DePuy Orthopaedics, Inc. are pushing for your ASR hip recall cases to be placed into Multi-District Litigation (MDL) in an Ohio federal court. The Hip Recall Alliance does not believe that in most cases this is in your best interests. We are filing lawsuits for our hip recall clients in state court against DePuy and its distributors. That’s what makes the DePuy ASR Hip Recall Law Firm Alliance different. Any attorney can file a hip recall case in the MDL and wait for something to happen. The Hip Recall Alliance attorneys are actively litigating hip recall cases right now.
